1. Scope and your service agreement
“Delegate”, “we”, “us” and “our” mean Delegate My Work Pty Ltd. The website is delegatemywork.com.au. The platform is my.delegatemywork.com.au and the related portals we make available. A “customer” is the agency or business that contracts with us; a “user” is a person authorised to access the platform.
We currently provide services to Australian agencies. Available functions and access depend on the services agreed with the customer and the user's permissions.
A signed service agreement, accepted order form or separately agreed statement of work governs the customer's purchased services, fees, subscription term, cancellation, support, data export and other commercial arrangements. That agreement prevails over these terms to the extent of an inconsistency. Publishing or updating these terms does not retrospectively amend it.
An invited user does not become liable for the customer's subscription fees merely by using a portal. A person does not agree to these terms merely because an agency records information about them. Our Privacy Policy explains personal-information handling; it is not blanket consent to every possible use of information.
2. Authorised access
Use only an account or invitation issued to you and only within your authorised access. Keep account details accurate, protect passwords and sign-in links, and tell us promptly if you suspect unauthorised access. Customers are responsible for managing their users' permissions and removing access when it is no longer authorised.
If information is made visible to you in error, stop using it and notify us and the relevant agency. Technical access does not itself give permission to use or disclose someone else's information.
3. Acceptable use
You must use the website and platform lawfully. You must not:
- access, change or disclose information without authority, impersonate another person, or use another person's credentials;
- introduce malicious code, interfere with the service, bypass security or access restrictions, or attempt to access another customer's workspace;
- upload or send unlawful, threatening, discriminatory, deceptive or infringing material;
- use contact details for an unrelated purpose or send unlawful unsolicited communications; or
- copy, resell or exploit our software or branding beyond your agreed rights, except where the law permits.
These conditions do not prevent lawful data exports, complaints, security reports or the exercise of rights that cannot be excluded by contract.
4. Records and property decisions
Customers and their licensors retain their rights in the information and materials supplied to their workspace. Using Delegate does not transfer ownership of that material to us or reduce an individual's rights in their personal information.
Customers must have authority to provide the information they upload and to instruct its use. They must provide required collection notices and obtain any necessary permissions. Do not upload unrelated identity documents, financial records, health information or other sensitive material simply because a file-upload field is available.
The platform helps organise records, work and communications. Customers remain responsible for their property and tenancy decisions, professional obligations, client instructions and statutory deadlines. Check records, templates, calculations and workflow outputs before relying on them.
Delegate does not become a party to a lease, agency appointment, sale or trade engagement merely because the platform is used. Any human-support service we agree to provide is governed by its agreed scope. Nothing here removes our responsibility for services we actually provide.
5. Messages, approvals and signing
Check recipients, attachments, permissions and your authority before sending information, approving work or signing a document. The consequences of an instruction or approval depend on the underlying arrangement with the relevant agency, owner, contractor or other participant.
Electronic delivery can fail or be delayed. A sent status does not necessarily establish that a message was read or legally received. Check that your chosen delivery or signing method is suitable for the document and transaction.
The platform is not an emergency service. For immediate danger, contact emergency services and use the emergency arrangements provided by the relevant property manager.
6. Connections to other services
Authorise a connection only if you have the right to share the information and grant the requested access. For the agreed trust-system sync, customers create a dedicated user in their external trust-account system. That sync arrangement uses multifactor authentication. Delegate's Philippines-based team accesses customer data through Delegate and does not directly access the customer's external trust-account system.
External services have their own terms and availability. A connection does not replace our obligations under the applicable service agreement or law. Contact us when a connection or its access is no longer required.
7. Fees, ending services and data export
Fees, renewal, cancellation, termination, data export and deletion are governed by the applicable service agreement and law. These terms do not introduce a new charge, export fee, minimum subscription period, automatic debit, liability cap or indemnity.
Stopping use of a user account does not itself cancel the customer's subscription or require deletion of records that must lawfully be kept. An individual's privacy access or correction request is separate from a customer's commercial export arrangement.
8. Availability and legal rights
Maintenance, internet connections, security work and external services can affect availability. Specific service levels and support commitments are those agreed with the customer; these terms do not create an additional uptime or response-time guarantee.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, privacy right or other right or remedy that cannot lawfully be excluded. The responsibility of each party remains subject to applicable law and the relevant service agreement.
9. Changes and questions
The effective date and version of these terms are displayed on this page. Updates apply prospectively and remain subject to any notice, agreement or other requirements in applicable law and the customer's service agreement. Publication alone does not change an existing commercial agreement or provide consent to a new use of personal information.
